Top Court Calls for Legal Reassessment
The Supreme Court has asked the Centre to consider amending existing laws governing termination of pregnancy, particularly in cases involving rape survivors, emphasising the need for a more humane and responsive legal framework.
The observation came while the court was hearing a case involving a minor rape survivor seeking termination of a pregnancy beyond the legally permitted limit.
‘No Time Limit’ for Rape-Related Pregnancies: Court
The bench noted that in cases of pregnancy resulting from rape, the law should not impose rigid time limits, given the severe physical and psychological trauma faced by survivors.
The court stressed that legal provisions must evolve with changing realities, underlining that “unwanted pregnancy cannot be thrust upon a person,” especially in cases involving minors and sexual assault victims.
Context: Case of Minor Survivor
The remarks came in the backdrop of a case involving a 15-year-old rape survivor with a 30-week pregnancy, where the Supreme Court allowed medical termination despite objections raised on medical grounds.
The court took strong exception to attempts to block the procedure, noting that forcing the survivor to continue the pregnancy could leave lifelong physical and emotional scars.
Existing Law and Its Limitations
Under India’s current legal framework, the Medical Termination of Pregnancy (MTP) Act allows abortion:
- Up to 20 weeks with medical opinion
- Up to 24 weeks for specific categories, including rape survivors
- Beyond that, only under exceptional conditions or court intervention
The Supreme Court’s observations highlight the gaps in the law when dealing with late-stage pregnancies arising from sexual violence.
Emphasis on Survivor’s Choice
The court reaffirmed that the final decision must rest with the survivor, supported by medical advice and family consent in the case of minors.
It also directed medical authorities to counsel the survivor’s family, ensuring that the decision is informed and centred on the well-being of the individual.
Push for Legal Reform
The Supreme Court’s intervention is seen as a significant push towards aligning reproductive laws with principles of dignity, autonomy, and mental health.
By calling for amendments, the court has brought attention to the need for a more flexible and compassionate approach—particularly in cases where legal timelines may not reflect the realities faced by survivors.
